RULES OF THE CALL FOR CONTRIBUTIONS
(the "Regulations")

This call for contributions is organized by the Banque de France ("the Banque de France").
The purpose of the Rules is to define the conditions and rules for participation in the call for contributions.
Participation in the call for entries implies full and unconditional acceptance of these Rules.
1. Duration of the call for contributions
The call for contributions begins on May 29, 2023 at 14:00 [UTC+1] and ends on July 12, 2023 [UTC+1]. The call for contributions is available 24 hours a day on the website accessible at the URL : Le Lab Banque de France - Accueil (banque-france.fr), subject to possible computer maintenance operations or malfunctions.
2. Acceptance of the Regulations
Any person registered on the Call for Entries Site ("the Participant") must read and expressly accept the Rules. By accepting the Rules, the Participant :
- Entered into a legally binding contract with the Banque de France. Provided that registration and participation in the call for contributions shall in no way create a subordinate relationship between the Banque de France and the Participant; and
- Accept fully and unreservedly to abide by all the provisions of these Rules. The acceptance is done by means of an online box to be checked when registering for the call for entries.
Failure to comply with the aforementioned rules will result in immediate disqualification from participation and possible participation in an experiment.
3. Registration and participation in the call for contributions
To participate in the call for contributions, we must have received your full registration by June 26, 2023 at 11:59 pm [UTC+1].
In order to participate in the call for contributions, the Participant must have created a user account on the call for contributions website and filled in the required information, such as name, first name, e-mail address, etc., in a loyal and complete manner.
Participants who have not provided proof of their complete contact information and identity or who have provided it inaccurately or falsely will be disqualified, as will persons who refuse the collection, recording and use of personal information concerning them that is strictly necessary for the purposes of managing the call for entries. The information provided by the Participant as part of his registration for the call for entries is his responsibility and any error, anomaly, inconsistency, whether intentional or not, relating to the information communicated by the Participant will lead to his disqualification.
The Banque de France reserves the right to carry out all necessary checks on the identity, postal and/or electronic address of the Participants.
The deletion of a Participant's user account on the Call for Entries Site shall be considered as an abandonment of the Participant's participation in the Call for Entries. In this case, the Participant, even if he/she is able to prove that this deletion is not his/her fault, will not be able to reintegrate the call for contributions, nor obtain any compensation from the Banque de France.
Similarly, to participate in the call for contributions, the Participant must have accepted these Rules when registering and creating a user account.
Registration and participation in the call for contributions is completely free of charge, and without obligation to purchase.
4. Conditions for participation in the call for contributions
The call for contributions is open only to :
- Natural Persons. A natural person who is eighteen (18) years of age and/or legally competent at the time of entry. Only one entry per person will be accepted for the Call for Entries.
- Legal entities. An entity regardless of its activity. For companies, the Banque de France may require, at its sole discretion, that they provide proof of (i) their registration in the Trade and Companies Register, by providing a KBis extract less than three (3) months old, or proof that their registration is in progress, and proof of the creation of the company in the country concerned and (ii) the subscription to a valid professional insurance policy.
All documents that can justify the eligibility of the Participant to the call for contributions will be requested during the selection process (e.g. identity document, extract from the KBis, etc.).
5. Principle of the call for contributions and modalities of participation
- Individuals. Participants must register for the call for contributions individually.
- Legal entities. When registering for the Call for Proposals, the Participant must designate, within its entity, a contact person for the Banque de France, responsible for registering and managing the Call for Proposals. The Participant represents and warrants to the Banque de France that this contact person (i) is duly authorized and empowered to bind the entity that he/she represents and to participate in the Call for Evidence on behalf of that entity and (ii) has obtained all necessary authorization to participate in the Call for Evidence, including the agreements of the authorized persons allowing the Banque de France to be granted intellectual property rights, where applicable.
The call for contributions consists in the realization by the Participants of a contribution (or project) formalized by deliverables, meeting the requirements set by the Banque de France in the specifications of the call for contributions. These specifications include information such as the various deadlines, the requirements of the Banque de France, etc. These specifications are available on the Call for Contributions website.
6. Deliverables
During the Call for Proposals, Participants may upload, via the Call for Proposals Site, any document or file (such as texts, presentations, videos, etc.) related to their project as a response and solution to the Banque de France's Call for Proposals (the "Deliverable").
To be valid, the Deliverables must (i) address the specific problem set out in the Call for Contributions, (ii) and generally meet the requirements set out in the Rules and in the Terms of Reference.
If a Deliverable cannot be downloaded, is not in the correct format, or is incompatible, illegible or unintelligible, it will not be accepted. The applicant will not be disqualified, but the response will be analyzed without the deliverable.
By submitting a Deliverable, Participants represent and warrant that:
- The Deliverable is composed solely of contributions from an individual Participant or a Company;
- Otherwise, if third party content has been used in the preparation of the Deliverable, all rights, permissions and agreements necessary to submit the Deliverable and grant the rights mentioned herein must be obtained by the Participant as of the submission of its contribution. Any use of an element covered by an intellectual property right without the authorization of the holder of this right will result in the disqualification of the Deliverable and the Participants concerned in accordance with Article 11 ;
- The content of the Deliverable does not and will not violate any third party rights, including (but not limited to) intellectual property rights, privacy rights, competition law, confidentiality, or any other contractual or extra-contractual rights. Any Deliverable suspected of violating third party rights and/or law(s) will be ineligible for the Call for Entries.
Participants are responsible for all costs and expenses related to the preparation and submission of Deliverables. Participants are solely responsible for damaged, lost, delayed, incomplete, invalid, incorrect or misdirected Deliverables.
7. Conduct of the call for contributions
Stages of the call for contributions. The call is composed of two selection phases:
- The first stage of pre-selection of candidates: Deliverables are accepted until June 26, 2023 at 11:59 pm [UTC+1]. At the end of this stage, a maximum of 10 Participants will be selected and will proceed to the second stage.
- The second stage - the oral presentation: It will be held from July 5 to July 7, 2023 [UTC+1]. At the end of this stage, a maximum of 3 Participants will be selected.
Deliverables. Failure by a Participant to submit a Deliverable on the Call for Contributions website by the deadline shall be considered as a withdrawal from the Call for Contributions. The Participant will not be able to re-enter the call for contributions, nor will he/she be able to obtain any compensation from the Banque de France.
Selection Criteria. Deliverables will be judged according to the selection criteria set forth in the Terms of Reference for the Call for Proposals. The Participant acknowledges that he/she is aware of and accepts that the proposed Call for Contributions will require his/her creativity, sagacity, skill and ingenuity to solve complex problems.
Notification to Participants. Once the selection process is complete, Participants will be notified by email, telephone, or any other means, at the sole discretion of the Banque de France, of the results of each selection stage. The Banque de France will be free to change the dates on which the results are communicated in the event that the number of projects to be examined makes such a change necessary. The results will be announced as of July 12, 2023.
Composition of the Jury. The Jury will be composed of employees of the Banque de France.
A. The first stage of the selection process
All Deliverables for this stage must be received by the Banque de France by June 26, 2023 at 11:59 PM [UTC+1]. Deliverables must meet the specifications defined in Section 6 above, and must include:
- The expected content indicated in the specifications of the call for contributions.
- A presentation of the Participant, based on the questionnaire to be completed in the participation area, which is accessible online via the user account.
In this first selection stage, the evaluations will be conducted as a criterion-based evaluation, and will take place from June 26 to June 29, 2023.
The members of the jury of the Banque de France (hereinafter the "Jury") may evaluate and select the Deliverables according to their content and the criteria indicated in the specifications of the Call for contributions.
Except as provided below, a maximum of 10 Participants with the best evaluations at the end of the first stage will participate in the next selection phase.
Participants will be notified of the results of the first selection stage on June 30, 2023.
B. The Oral Presentation
Participants pre-selected to participate in the oral presentation phase will be contacted directly by the Banque de France. In the absence of confirmation of participation from them when the Banque de France has tried to contact them by e-mail and by telephone, the Banque de France reserves the right, at its sole discretion, to disqualify the Participants concerned. This disqualification, if applicable, shall not give rise to any compensation from the Banque de France.
This last phase will consist of an oral presentation of the solutions by the Participants. It will be held from July 05, 2023 to July 07, 2023.
This oral presentation will include the following:
- A business use case proposal
- A presentation of the technical and application architecture proposed for the experimentation
- A presentation of the Participant
Depending on the Participant's initial file, the Banque de France may ask the Participant to complete its oral presentation with the elements necessary for a proper understanding of the Participant's proposal.
At the end of the oral presentation, the jury will be in charge of choosing the 3 most relevant projects for the Banque de France.
9. Communication
The Participant acknowledges and agrees that the Banque de France may, for the duration of the call for entries and for a period of three (3) years following the oral presentation, use the call for entries for communication purposes of the Banque de France, in any format, medium and support (website, advertising banners, social networks, newsletter, press release, etc.), whether known or unknown to date, free of charge or against payment.
To this end, you consent to the use by the Banque de France of your first and last names, the name of your company and its distinctive signs (if you are a Company), the information relating to the call for contributions (if you are selected), as well as the content of your Deliverables relating to the call for contributions. Each Participant also authorizes the Banque de France to use the photographs taken during the selection stage in order to disseminate them on any communication medium.
This use does not entitle you tò any remuneration, nor does it require any additional consent on your part. The Banque de France expressly undertakes to cease all use of the above-mentioned elements in connection with the Participant at the end of the above-mentioned period.
10. Privacy
In general, by submitting a Deliverable, Participants acknowledge and agree that the information contained therein may be disclosed to the public by the Banque de France.
In addition, Participants acknowledge that the Banque de France may develop on its behalf, or may receive from third parties, information similar to that contained in any of the Deliverables. Accordingly, nothing in these Rules prohibits the Banque de France from independently acquiring, independently developing, or having independently developed products, concepts, systems, services, or techniques that are similar to or that may compete with the products, concepts, systems, services, or techniques that a Deliverable presents or provides.
Participants acknowledge that other Participants may have provided or may provide in the future to the Banque de France or to third parties, or may have disclosed to the public or will disclose, content that is similar or identical to information contained in a Deliverable. Accordingly, Participants acknowledge and agree that the Banque de France has the right to use such similar or identical content, and that Participants shall not be entitled to any compensation for the use of such content by the Banque de France.
11. Intellectual Property
Definitions. For the purposes of this section, the following definitions apply:
- Intellectual Property Rights" means any copyright or other rights relating to a trademark, design, patent, software and, more generally, any item (including trade secrets and know-how) that may be protected by national and/or international laws or conventions relating to intellectual property ("Intellectual Property Rights");
- Prior Rights" means any intellectual property rights and/or associated know-how owned by Participants prior to the start date of the Call for Submissions ("Prior Rights");
- Creations": any software (including source code and object code), database, technical specification, text, design, model, information, knowledge, method, process or product, as well as any element and/or process resulting therefrom, developed by a Participant as part of a Deliverable submitted in the course of the Call for Entries and which may be protected or may be susceptible to protection under applicable national and/or international laws and conventions relating to intellectual property ("the Creations")
Guarantee of non-infringement. By submitting a Deliverable, at any stage of the call for contributions, each Participant guarantees to the Banque de France that he/she is the co-owner and/or co-owner of the Intellectual Property Rights relating to all or part of the Creations contained in the Deliverables, and that he/she has obtained all the necessary rights and authorisations relating to these Creations, whether pre-existing or belonging to a third party, as recalled in Article 6.
Each Participant warrants that: (i) its Contributions do not infringe the rights of any third party; (ii) all elements of its Contributions and all information provided in the Deliverables are accurate, reliable and complete; and (iii) submission of the Deliverables does not constitute an act of unfair competition.
Participants must include the source of all pre-existing Creations included in the submitted Deliverables. Any Deliverable that has been developed by multiple Participants constitutes a collaborative work and should be treated as such under applicable rules.
Liability. The Banque de France may not be held liable in any way for any violation by Participants of the above provisions. Each Participant shall indemnify the Banque de France in the event of claims, oppositions, actions, or attempted eviction by a third party, relating to any of the Creations contained in the Deliverables (including the associated intellectual property rights).
By submitting a Deliverable and participating in this Call for Contributions, you do not grant the Banque de France any Intellectual Property Rights in all or part of the Deliverable, except as provided in sections 9 and 10 of these rules.
12. Amendment of the Rules, Suspension and Cancellation of the Call for Contributions
Updating of the Rules. The Banque de France reserves the right to modify the provisions of the Rules at any time, including the duration of the call for contributions, if operational imperatives so require, without the application or validity of these modifications requiring any notification to the Participant. The Participant is invited to consult the Rules regularly. The Participant expressly waives any claim or challenge relating to any amendment made to the Rules by the Banque de France.
In the event that one or more provisions of the Rules are deemed illegal, invalid, unenforceable or unenforceable by a court decision, the remaining provisions of the Rules shall remain in effect.
Suspension or Cancellation of the Call for Proposals. The Banque de France reserves the right, at its discretion, to (i) cancel, terminate, modify or suspend the Call for Entries and the Rules for any reason at any time without liability, and (ii) limit or restrict participation in the Call for Entries. The Banque de France shall not be liable for the modification, cancellation or suspension of the Call for Entries, and no compensation or remuneration shall be due to the Participants.
13. Limitation of liability
The Banque de France shall not be held responsible for any disruptions to the Internet network or for access difficulties due to a large number of participants or connections. The Banque de France cannot be held responsible in any way for communication or access interruptions, loss of data, computer viruses or any direct or indirect prejudice whatsoever that may be suffered by a Participant before, during or after his or her participation in the call for contributions.
The Banque de France shall not be held liable for any facts or damages that are not directly or indirectly attributable to it, in particular those resulting from errors or delays in the submission of the Deliverables by the Participants, including the refusal to accept these Deliverables due to their submission outside the scheduled dates, damage resulting from errors or delays in sending e-mails by the Participant in the context of the call for contributions, as well as damage resulting from any alteration made to the Deliverables beyond the control of the Banque de France, or from an event of force majeure likely to disrupt, modify or cancel the call for contributions.
Consequently, the Participants waive any recourse against the Banque de France and its employees for damages and/or losses they may suffer in the context of the call for contributions.
The Banque de France shall not be held responsible for any incident that may occur in the context of the services provided under the experiment, and all responsibility in this regard shall rest with the third-party company or companies with which the selected Participants contract directly.
The Banque de France shall in no way be held liable for the consequences of a Participant's disqualification due to the latter's violation of the Rules.
- Protection of personal data
Participation in the Call for Entries requires the disclosure of the Participant's personal data ("Personal Data").

15. Governing Law and Dispute Resolution
The Rules and the specifications of the call for contributions are subject to French law
In the event of a dispute persisting beyond a period of fifteen (15) days after the Participant has made a claim, the Banque de France and the Participant undertake to submit their dispute to amicable conciliation prior to any legal proceedings. The party wishing to enter into conciliation shall inform the other party by registered letter with acknowledgement of receipt, in which it shall inform the other party of its intentions and specify the reasons for them. If no agreement is reached between the parties within thirty (30) days of receipt of the registered letter, the parties shall regain their freedom of action.
In case of persistent disagreement on the application or interpretation of the Rules or the specifications, and in the absence of amicable agreement, any dispute that may arise between the parties shall be submitted to the exclusive jurisdiction of the competent courts of the Paris Court of Appeal.
